Graves, J.:
W. H. Rich, on- April 17, 1906, commenced this action in the district court of Wichita county to quiet his title to the land, in controversy against the claims of John S. Downs, who was asserting ownership thereto. The defendant in his answer denied the claim of thé plaintiff, alleged ownership and possession in himself, and prayed that his title be quieted- as against the claims of the plaintiff.
