Appeal from a judgment of the County Court of Chemung County (Hayden, J.), rendered December 17, 2012, convicting defendant upon his pled of guilty of the crime of attempted criminal possession of a weapon in the second degree.

At roughly 9:40 p.m. on June 24, 2012, a police officer observed defendant riding a bicycle on the sidewalk in the City of Elmira, Chemung County in violation of a city ordinance.
