Plaintiff, in this appeal from an order granting defendants 1 summary judgment, contends that the motion was erroneously granted.

All counts of the amended complaint related to a contract between plaintiff and Anthony Pontarelli and Sons, Inc. (hereinafter referred to as Pontarelli) for the construction of a sewer.
