Bose Henderson was tried for and convicted of the murder of Tobe Caldwell. The evidence for the State tended to show that some months prior to the homicide there had been a difficulty between the deceased and the defendant, in which difficulty the defendant was shot by the deceased. There was an effort to settle that difficulty by the payment of the physician's bill and compensation for the time lost by the defendant while he was laid up with the injury.
