One of the plaintiffs, Charles J. Delfosse, for the use of B. A. L. Thomson, instituted a suit before A. C. Strayer, a justice of the peace, against Oscar Holler, and obtained a judgment against Holler in due course for $96.40. From this judgment Holler prosecuted an appeal to the Circuit Court and defendant signed with Holler as surety the appeal bond. After the Circuit Court acquired jurisdiction of the appeal, on motion of Delfosse the papers were all amended, making plaintiffs in the cause George J. Haberer and Charles J. Delfosse, partners, etc., as Haberer & Delfosse, for use of B. A.…
