Brannon, Judge:

Isaac Newman died in 1836 leaving a will and a large estate consisting of various tracts of land and slaves and other personal property. His will contained the following provisions: “I do hereby authorise my beloved widow to dispose of my property real and personal when it shall be for the benefit of the family and in all cases it shall be legal in law for the benefit of my eight children namely Junius Eastham Newman, Virginia Eastham Newman, Mary Cathrine Newman, William Walter Newman, John Green Newman, Susan Ann *372Newman, Sarah Jane Newman, Isaac Vanburen Newman and if any…
