Appeal from judgment of the General Term of the Superior Court of the city of Hew York, entered upon an order made July 1, 1889, which affirmed a judgment in favor of plaintiff entered upon a verdict and affirmed an order denying a motion for a new trial. The nature of the action and the facts, so far as material, are stated in the opinion.

A statement of tlie facts which, it seems to me, must control the decision of the appeal in this case may be very brief. The action was brought by plaintiff to recover of defendants the moneys paid by him to them from time to time towards the purchase-price of one thousand shares of the stock of the Manhattan Refining Company, but which the defendants refused or failed to deliver pursuant to their obligations.
