Robert D. Ackley brings this suit as a relator under the qui tarn provisions of the False Claims Act (FCA), 31 U.S.C. § 3729 et seq. 1 He alleges that International Business Machines Corporation (IBM) systematically defrauded the United States in connection with a subcontract to provide labor and materials for the deep space orbiting space station known as Space Station Freedom (Space Station).
