James Simpson met Ms death in appellee’s mine. His widow, as administratrix, filed petition charging that while decedent was engaged as a coal loader and “was returning from his place of work, he was killed by a .mass of falling slate, all due to the negligence of the employer.” She sought recovery in the amount of -$10,000.
