The plaintiff, John Baker, appeals the district court’s entry of summary judgment for the appellees, City of Iowa City, Iowa, and Iowa City Human Rights Commission, based on the court’s conclusion the plaintiffs claims were moot. In addition, Baker contends the court erred in failing to rule as a matter of law that the City’s ordinances exceed its home rule powers in two particulars: (1) the prohibition of discrimination by small employers; and (2) the prohibition of discrimination on the basis of marital status.
