The plaintiff objects (Doc. 22) to the August 5, 2009, report and recommendation (Doc. 21) in this case and the defendant responds, concurring with the magistrate judge’s findings (Doc. 23). A de novo determination of those portions of the report and recommendation to which the plaintiff objects reveals that the objections either are unfounded or otherwise require no different resolution.
