OPINION

WALKER, Presiding Judge.

After an evidentiary hearing, the trial judge found Brewer’s petition for post-conviction relief without merit and he has appealed to this court. He challenges as void his conviction for murder in the first degree and sentence to thirty-five years and one day.

Brewer contends that he was denied the effective representation of counsel by his two retained attorneys. When a defendant is represented by privately-retained counsel, state action is not involved and the action or nonaction of such counsel is imputed to the defendant and not to the state. Morgan v.
