This case is presently before the court on defendant’s motions for summary judgment, judgment on non pros and termination of inactive case.
The parties have stipulated to the following facts: plaintiffs, James R. DeMauro and Antonio Ricco d/b/a Olympia Spa, Inc., owned real estate and a building in Ellwood City, Pa., where they conducted their business. In order to protect this property, they had a fire insurance policy (No. 40FS395719) issued to them by defendant, Hartford Fire Insurance Co., on January 21, 1974, effective for three years.…
