Suit by appellant against appellees for commissions alleged to, have been earned by appellant in a contract with appellees to bring about the exchange of certain properties between appellee Jones and T. S. Masterson.

The entire transaction, as alleged by appellant, was quite lengthy and complicated, but the effect of plaintiff’s pleadings is: (1) That Jones agreed with Smith that if Smith would negotiate a sale of certain real estate situated in the city of Houston, Tex., to T. S. Masterson on certain specific terms and conditions, then Jones would pay Smith, as his commission, certain parts…
