MEMORANDUM OPINION AND ORDER
JENKINS, Senior District Judge.
On January 6, 1999, the above-captioned action came on for hearing on the defendants’ separate motions for summary judgment. At the hearing, Carlie Christensen, Assistant United States Attorney, argued the motion on behalf of the United States and the United States Forest Service; Barbara K.
