STEWART, Justice.
Appellant, Ray Grant, was indicted at the October term, 1950, of the Madison Circuit Court, charged with the wilful murder of Charlie Isaacs, and at a trial on October 18, 1950, he was convicted of voluntary manslaughter and his punishment fixed at confinement in the penitentiary for 21 years.
