This is an appeal by the respondents Frances Locke Clarke and George C. Marvin from a decree entered by the Probate Court on a petition for instructions by the trustee under the will of Warren E. Locke, late of Lexington, deceased.

The controversy arises out of the fourth and fifth paragraphs of the will which read as follows: “Fourth All the rest, residue and remainder of my estate, of which I may die seized and possessed, or to which I may be entitled at the time of my decease, I give, devise and bequeath to my said brother, Herbert G.
