On October 19, 1936, Virgil A. Murray filed with the Superior Court of San Diego County his petition for a writ of mandate directed against the Civil Service Commission of San Diego County and the individual members thereof. In the petition thus filed the petitioner alleged that the county of San Diego is a body corporate and politic organized and existing under and by virtue of the terms of a freeholders’ charter duly adopted and ratified and being in full force and effect at all times mentioned in the petition.
