POMEROY, Justice.
This appeal arises from a complaint in District Court on an account 1 and from an attachment, ancillary to the complaint, of certain sums of money derived from the appellee’s cash receipts.
The appellee, Samuel Share, was duly served on August 18, 1973, with the complaint, summons, motion for approval of personal property attachment, and a notice of hearing and affidavit supporting the motion.
