O'Dell v. Newton

Supreme Court of Arkansas

1Opinion of the Court

J. SeaborN Holt, Associate Justice.

This appeal is from a decree of the Pulaski Probate Court voiding the will of J. F. Parmer, deceased, on the ground that the testator lacked mental capacity to make the will. The sole question presented is whether the finding of the trial court, that J. P. Parmer lacked mental capacity to make his will, was against the preponderance of the evidence. After a careful review of all the testimony, we have concluded that appellant’s contention that the findings and decree of the trial court were against the preponderance of the testimony must be sustained.
