HEISKELL, J.-

This is an appeal by the City from a judgment for' $7,000 damages for the death of Ray Trice, a boy about seven and a half years of age. We will state the facts so far as we think material^' in the terms of the contention of plaintiff.

In the City of Memphis there is a block of property lying on the west side of Delaware Street owned by the Phelan estate. Originally there extended across this property a ravine or deep gully leading to the Mississippi River not far away, which was a natural surface water drain.
