The plaintiff, Field, seeks recovery of damages for injuries to his person and to his automobile, claimed as the result of the negligent driving of a stage of the defendant transportation company. The insurance association was made a defendant because of its having issued and filed with the department of public works, as required by law, its insurance policy, indemnifying persons sustaining injuries to their persons or property resulting from the negligence of the transportation company in the sum of five thousand dollars.
