The defendants, appellants here, were the trustees of the Kootenay Consolidated Mining Company, a corporation. During their term of office they were removed as such trustees, and other trustees were elected to fill the vacancies. The appellants refused to vacate their positions as trustees, and this proceeding in quo warranto was brought in the name of the State of Washington ex rel. the respondents, for the purpose of ousting said appellants from their' positions.
