Plaintiff, B. Marvin Potler, as trustee in bankruptcy for Underwater Advisors Corporation (“UAE”), brings this diversity action 1 against MCP Facilities Corp. (“MCP”) and Bethlehem Steel Corporation (“Bethlehem”) to recover $81,250 in damages, including expenses and lost profits, allegedly suffered by UAE as a result of its inability to complete an underwater painting job for Bethlehem at Beaumont, Texas.
