The defendant, Marvin Kitchens, appeals1 from the judgment of conviction, rendered after a jury trial, of kidnapping in the second degree in violation of General Statutes § 53a-94 (a)2 and unlawful restraint in the first degree in violation of General Statutes § 53a-95 (a).3 On appeal, the defendant claims that the trial court improperly (1) failed to instruct the jury, *450in accordance with State v.
