I. INTRODUCTION

Plaintiff John Gill Smith instituted this action on December 1, 2003 against defendant City of Philadelphia alleging violations of the Americans with Disabilities Act, 42 U.S.C. § 12132, the Rehabilitation act of 1973, 29 U.S.C. § 749, the Pennsylvania Human Relations Act, 43 P.S. §§ 951-963 and the Human Relations Fair Practices Ordinance, Philadelphia Code § 9-1105, et seq.
