MEMORANDUM AND ORDER

Currently before the court is petitioner’s petition for writ of habeas corpus, filed on October 30, 1987. For the reasons that follow, the court will deny petitioner’s application for habeas relief.
BACKGROUND
This action arises out of petitioner’s conviction in the Luzerne County Court of Common Pleas of two counts of driving under the influence of alcohol and one count of leaving the scene of an accident involving death or injury.
