We find a full and accurate statement of the facts of this case in the opinion of the Court of Civil Appeals, as follows:
“The bills in these cases were filed by complainants against defendants Illinois Central Railroad Company and J. H. Weatherford, the purpose of the bills being to enjoin the railroad company from constructing a proposed spur track on IWIagner street in the city of Memphis. The cases were consolidated and heard under the above style. Before the final decree, the bills were dismissed as to J. H. Weatherford and he is no longer a party to the cause.
