This is a petition for a new trial on account of alleged errors in the rulings and charge of the court, in the trial of an action against the defendant as indorser of a promissory note for $500. The note was made by Charles Heptonstall, payable to the order of the defendant, indorsed by the defendant, and subsequently indorsed by P. M. Stone, and by American Manufacturing Company by P. M. Stone, treasurer.
The plaintiff, in the special count of his declaration, alleges that the defendant indorsed and delivered the note to him, without setting forth the intermediate indorsements. On the trial,…
