OPINION ON APPELLANT’S PETITION FOR DISCRETIONARY REVIEW

CLINTON, Judge.

Appellant was convicted of capital murder, V.T.C.A. Penal Code, § 19.03(a)(3), and, upon a negative finding on future dangerousness, Art. 37.071, V.A.C.C.P., sentenced to life imprisonment. On appeal, the court of appeals for the Ninth Supreme Judicial District affirmed with one justice dissenting. Goode v. State, No. 09-33059CR (delivered February 21, 1985) (unpublished).
