I. INTRODUCTION

Plaintiff, Joseph Napolitano, Jr. (“Napoli-tano”), used to be a member of defendant, International Union of Operating Engineers, Local No. 4 (“Union”), but he was suspended from membership in 1981 for nonpayment of dues. Napolitano maintains that he was rendered unable to pay dues by the Union’s failure to assign him work in retaliation for his earlier complaints about nepotism on the part of Union management.
