This is an action of trespass, brought March 26, 1907, by John R. Forrest to recover damages for injuries which he sustained by reason of the alleged negligence of the defendant company, in July, 1906. The statement was filed, a rule to plead was granted June 3, 1907, and on June 17th the defendant pleaded “not guilty.” The plaintiff, died November 2, 1907, and in October, 1915, his death was suggested, and June 5,1916, his death was again suggested of record and Indiana Forrest, his administratrix, was substituted as plaintiff.
