—In an action to recover damages for medical malpractice, the defendant appeals from an order of the Supreme Court, Nassau County (Schmidt, J.), dated January 13, 1995, which, inter alia, denied his motion to dismiss *610the complaint and to preclude the plaintiff from presenting expert medical testimony.

Ordered that the order is modified by adding a provision thereto directing that the plaintiff’s attorneys pay to the defendant’s attorneys the sum of $2,500 within 30 days after service upon them of a copy of this decision and order with notice of entry; as so modified, the order is affirmed,…
