The Haney School Furniture Company instituted an action against the Hightower Baptist Institute, on an open account for thirty school desks, one reading-chart, and a lot of blackboards. It was admitted that the defendant was a corporation created for the purpose of promoting education by carrying on a school, and that its business was managed by a board of trustees; but it was denied that defendant was indebted to' plaintiff in any sum.
