Nancy B. Thomas sued her sister, Mrs. Alice Sater, to cancel a warranty deed executed by plaintiff on February 8, 1954, which conveyed real estarte in the City of Springfield to Mrs. Sater. While the case was under submission, Nancy B. Thomas died and, on motion, her administrator and heirs were substituted as parties plaintiff. The trial court’s judgment canceled the deed and appellant, defendant below, has appealed from that judgment. We shall refer to the parties as they were designated in the trial court, and “plaintiff” herein will designate the original plaintiff,…
