Plaintiff sues for $2,249.00 damages for personal injuries, loss of time, etc., alleged to have, been caused by the negligence of the defendant company. The basis of his charge of negligence is that the car was started without warning, just as he was about to step from the rear platform to the ground, and he was precipitated unknowingly into a trench, or hole, about ten feet long, three feet wide and more than six feet deep, which had just been dug by defendant company alongside of the track.
