This action was brought by plaintiff union to recover -money damages from defendant insurance company for breach of a contract of insurance. The trial court held in favor of plaintiff. Defendant appeals.
Plaintiff is one of thirty-six local unions, all of which are members of Western States Conference of Operating Engineers. In late 1970, defendant, in competition with other insurance carriers, presented the Western Conference of Operating Engineers with the lowest bid for a group life insurance policy.
