The questions involved in this case are pure questions.of law, as there is no controversy over the facts, which, so far as they are material to the questions raised, are as follows:

In the year 1868 John H. Core, the appellee, married Mrs. Murry, who, at the time of her marriage, was the owner of a common law estate embracing two parcels of land. One parcel was situated in the city of Norfolk and the other in ISTorfolk county. In the year 1870 Core and wife executed a deed purporting to convey both parcels of land to a trustee.
