Cardona, P. J.(1) Cross appeals from an order of the Supreme Court (Monserrate, J.), entered April 6, 1995 in Broome County, which, inter alia, granted defendant Anthony C. Palombaro’s motion for summary judgment dismissing the complaint against him, and (2) appeal from the judgment entered thereon.
