This a garnishment proceeding. Most of the controversy is over immaterial matters. Originally, it is claimed, the Johnson Hardware Company recovered a judgment against J. B. Marshall. At any rate the company obtained an execution against him, which it sought to levy through process of garnishment against the defendants Evan S. Rees and Rees Tobacco Warehouse Company, as it was called in the summoning notice. The execution came into the hands of one J. W. Keens, deputy sheriff, and he executed the same on the said Evans S.
