We granted certiorari in this case to consider the Court of Appeals’s determination that evidence of a party’s violations of traffic laws is sufficient to create a jury question as to whether that party acted in bad faith for purposes of authorizing an award of expenses of litigation under OCGA § 13-6-11.1 See McKnight v.
