GILES, District Judge.

This court has before it defendants’ motion for summary judgment. Plaintiff, a *836prisoner in the State Correctional Institution at Graterford (hereinafter “Grater-ford”), commenced the underlying action against defendants, officials in the Pennsylvania Department of Education and Pennsylvania Bureau of Correction, pursuant to 42 U.S.C. § 1983 and its jurisdictional counterpart 28 U.S.C. § 1343.
