CONNALLY, District Judge.

Proceeding under the Federal Tort Claims Act, 28 U.S.C.A. §§ 1346, 2671-2678, 2680, plaintiff seeks recovery of the United States for the personal injuries which he received as result of a collision between the automobile in which he was riding as a passenger and a government vehicle. The vehicle in which plaintiff was riding was proceeding along a well traveled highway, in or near the City of Livingston in Polk County, Texas, when it was struck near the right front door- by the government vehicle which entered from a lateral road.
