An action to recover damages for the death of Mag-nus Binnan, who was struck by a street car and died three days later as the result of the injuries received in the accident. At the close of plaintiff’s case the trial court, upon motion of defendants, instructed the jury to find defendants not guilty. Plaintiff appeals from a judgment entered upon the verdict.
