“This is an action brought by the First State Bank of Tomball, hereinafter called the bank, and Ed. Hall, acting in his official capacity as Commissioner of Insurance and Banking of the State of Texas, against the National Surety Company and R. W. Leslie, for the purpose of recovering on a fidelity bond executed by defendants in favor of the bank, by the terms of which the said R. W. Leslie, as principal, and the National Surety Company, as surety, undertook to indemnify the bank against such pecuniary loss as it might sustain of money or other valuable securities embezzled, wrongly…
