— The indictment was signed by Carroll O. Switzer, County Attorney of Polk County. The assistant Polk County Attorney, Ed S. Thayer, and Paul E. Hellwege, County Attorney of Boone County, conducted the trial for the State.
It is not contended by the State that the defendant was the principal actor in the crime charged in the indictment, nor that he obtained Polk County warrant No. A-49864_ for $703.07 from the county auditor, nor that it was payable to him, cashed by him or that he ever received any part of its proceeds.
