Appeal by the plaintiff Maria J. Ventriniglia, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of New York on or about the 28th day of June, 1912, upon the decision of the court, rendered after a trial at the New York Special Term, dismissing the complaint.

Laughlin, J.:
This is an action to remove a cloud upon title to real property, created by a lease for 1,000 years given on a sale of premises for the non-payment of certain taxes and water rents. The tax sale took place on the 10th day of October, 1906, and was for the unpaid annual taxes for the years 1900 and 1901, and the unpaid water rents for the years 1899 and 1900, which were added to the assessment rolls for the succeeding years respectively.
