On or about March 12, 1975, the plaintiff and Theodore Burch, Jr., entered into an agreement whereby the plaintiff would acquire three pieces of John Deere construction equipment and would obtain the titles to them once they were completely paid for. According to the terms of the agreement, Burch would be responsible for the payment of all taxes, operating expenses, and repairs, would maintain insurance on the equipment, and would remit to the plaintiff each month an amount of money which would cover the cost of the monthly installment loan payments.
