The indictment in this case was found at the September term, 1889, and charged that the defendant, Jasper Pulliam, “unlawfully and with malice aforethought, but without premeditation, billed Anderson Ross, by shooting him with a pistol.” Issue being joined on the plea of not guilty, the defendant was convicted of manslaughter in the first degree, and sentenced to the penitentiary for the term of four years. Dying declarations are received as evidence only in trials for homicide. They are limited in their scope to the act which causes the death, and the attendant circumstances, or res gestee.
