On this day, the Court considered the United States of America’s motion to quash. Doe. No. 48. After careful consideration, the Court GRANTS the motion.

BACKGROUND

On December 11, 2012, Defendant Jose Socorro Avalos-Martinez was arrested by federal authorities and charged with illegal reentry into the United States in violation of 8 U.S.C. §§ 1326(a) and (b)(1). Defendant contends that when he reentered the United States on January 8, 2001, he did so with the permission of the officials at the Eagle Pass port of entry (“POE”). Doc. No. 39.
